A settlement between Activision and Double Fine regarding Brutal Legend has been reached.
The lawsuit initially came about around E3, with Activision alleging that it still had publishing rights to the game and that Double Fine had no right to transfer publishing rights to Electronic Arts.
A month thereafter, Double Fine filed a countersuit, stating "Activision will not kill Brutal Legend," and alleging that
Activision had no interest in the game and simply wanted to stop it from competing with - of all things - Guitar Hero.
More recently, Activision requested that Brutal Legend's release be delayed from 16 Rocktober with the hearing scheduled for 6 August - yesterday. Presiding judge Los Angeles Superior Court Judge Craig Karlan stated that the request may be denied, noting "I can't say there's a likelihood of success here," but adding "This is going to be a close call."
Now, it seems that it's all settled (pun intended.) According to the Associated Press, Los Angeles Superior Court spokeswoman Vania Stuelp said that attorneys for Activision had notified the court of a settlement agreement with Double Fine, presumably prior to the hearing. Naturally, no information on the details of the settlement is available.
