Double Fine's Brutal Legend may not be delayed due to the ongoing legal battle between Activision and Electronic Arts over the title.
Essentially, Activision alleges that it still has the rights to publish the game, but was recently served a countersuit alleging that the company has no interest in the game and simply wants to stop Brutal Legend from competing with Guitar Hero.
According to the Associated Press, a recent hearing was held to determine whether or not Brutal Legend's release should be delayed from 16 Rocktober, as requested by Activision. The presiding judge, Los Angeles Superior Court Judge Craig Karlan, has stated that the request may be denied.
"I can't say there's a likelihood of success here," said Karlan, referring to Activision's chances, although he added that he doesn't think either side has the upper hand in the case. "This is going to be a close call."
Either way, the hearing has been rescheduled to 6 August, so there's still plenty of time for things to change.
We hope to see Brutal Legend hit store shelves as soon as possible, because from our previews and interviews, we're really excited.
