The on-going saga between the company behind Scratch: The Ultimate DJ (Scratch DJ Game LLC) and Activision took a new turn today after a judge ruled in favour of Scratch the Ultimate DJ
A few days ago it was reported that a court had found no evidence of any foul play by Activision following allegations that the publisher acquired 7 Studios in order to "withhold the current version of Scratch in an effort to delay the development andrelease of Scratch". However, today the turn-tables have indeed been turned.
A judge has now ordered 7 Studios, now owned by Activision, to "turn over to Scratch DJ Game LLC within five days all source code related to Scratch – The Ultimate DJ game, including 7 Studio’s pre-existing developer software tools and technology that went into developing the game". The court concluded that the source code was the property of Scratch DJ Game LLC and that Activision were trying to prevent Scratch getting a head-start on their own DJ Hero title.
The court also granted an injunction which now causes a problem for Activision who can no longer discuss the Scratch game code or anything to do with the game with its own development studio 7 Studios.
Scratch DJ Game LLC will now pursue Activision, 7 Studios and 7 Studios' CEO Lewis Peterson for damages.
